Apple VS Samsung(Droid)

Well, in case you missed it, the courts ruled in favor of Apple against Samsung, stating that Samsung had violated several of Apple's patents.

Well, this is not how I had hoped this case would go. Geez, this sets a dangerous precedent if this doesn't get stopped in the end.

Software patents should never have been allowed to exist...

Apple asked them repeatedly to stop before taking this to court. They didn't want this to have to go down this way but Samsung was belligerent towards Apple's claims and this is the result.

There's no doubt that Samsung tried to ride the iPhone gravy train by customising their version of Android and making the Galaxy S1 look a lot like a 3GS but personally I think at the end of the day the only loser here is the consumer. I think both sides looked bad in this.

Samsung make great hardware, heck they provide a lot of iPhone parts :) and the S3 is pretty decent. Let's hope this inspires them to greater things,

Yeah, I totally agree. Tim Cooke really regretted having to go down this road as they had a pretty good relationship with Samsung.

My main concern now is whether Apple is going to use this precedent to basically beat the stuffing out of the rest of the Android manufacturers. So maybe Samsung copied them, but you can't convince me the rest of them did. HTC alone has hardware and software that is very different from Samsung.

My main concern is the fair protection of intellectual property. You say "So maybe Samsung copied them" like it's a throw away line. It's not "so what" it's important. You have a lot to learn about the business world.

I don't think Apple should have been allowed patents to the software designs they have. "Pinch to zoom", "Double tap to zoom" & "bounce back". Its about as ridiculous as Apple having the patent to "slide-to-unlock" or "Scroll wheel on mouse" or "Right click brings up context menu". Because as far as touch screens are concerned, there are only so many ways you can interact with a screen. I can't really imagine it took a lot of innovation to design those touch moves. Idk, just my 2 cents on the matter.

That said, looking at the list, yeah, the design stuff was violated. The icons shouldn't have been used like they had been. That was a dumb move and Samsung should have known better. Hardware was also a little too close to Apple's. I can agree with hardware design patents, but not the software ones.

Definitely some appeals coming on this.  Seems like the jury botched a few things making the judge even send them back - especially with regards to damages.  Interesting to watch and read about.

Yeah, I doubt they judge will suspend sales of any of Samsungs products in the US, that would be an over reach for sure.

Finally how life mirrors drama.  I just finished Steve Jobs the biography by Isaacson.  SJ was an original, no one else like him.  Will be interesting to see how Apple fares over the long haul under Cook.

Bad for innovation.  The patent system needs to be scrapped and something else more modern put in its place.

Copyright only for software (it is written not invented). 

Big companies gather up patents for **everything** so the lawyers can wage warfare - I cannot remember a single instance in the press recently where an individual inventing something amazing was actually protected by a patent from a large corporation.  Which I believe was the original intent of the system?

Also I do wonder if both companies were American if the outcome would have been the same.  Or anyone other than Apple for that matter.
